Issue 104 - Withdrawn

We regret to announce that the Coral Company Central Park Mixed Use Development proposal has been withdrawn from consideration and will not be eligible for approval on the November 4th ballot.

Due to the nationwide financial situation, Coral Company and their partners have determined that the necessary capital is not available to meet their initial property purchase obligations required to commence the project.  The City of Solon certainly understands and appreciates the reasons that the Coral Company and partners have been  forced to this difficult decision.

The demise of the Central Park project represents an unfortunate loss of a significant redevelopment opportunity for the City.  However, be assured that we will continue to pursue new opportunities to revitalize our retail areas, improve traffic flow throughout the city, and provide City residents with the amenities and services that they expect and deserve.

AN ORDINANCE REPEALING ORDINANCE NO. 2008-180 WHICH
SUBMITTED TO THE ELECTORS THE QUESTION OF ENACTING A NEW
CHAPTER 1285 OF THE ZONING CODE CREATING THE CENTER OF TOWN
PLANNED UNIT DEVELOPMENT DISTRICT AND REZONING THE PROPERTY
KNOWN AS THE CENTRAL PARK PROPERTY TO THIS DISTRICT, AND
REQUESTING THE BOARD OF ELECTIONS TO WITHDRAW THIS ISSUE FROM
THE NOVEMBER 4, 2008 BALLOT, AND DISREGARD ANY VOTES RECEIVED  
FOR THIS ISSUE, AND DECLARING AN EMERGENCY  

                   WHEREAS, at its meeting of August 18, 2008, the Council approved Ordinance No. 2008 180 submitting to the electors the question of enacting a new Chapter 1285 of the Zoning Code creating the Center of Town Planned Unit Development District and rezoning the property currently known as the Central Park Property to the Center of town planned unit Development District; and

                   WHEREAS, it has since been determined the Planned Unit Development proposed by the Coral Company will not go forward. 

                   NOW, THEREFORE, be it ordained by the Council of the City of Solon, State of Ohio:

                   SECTION 1.  That Ordinance No. 2008-180 submitting to the electors the question of enacting a new Chapter 1285 of the Zoning Code creating the Center of Town Planned Unit Development District and rezoning the property currently known as the Central Park Property to the Center of town planned unit Development District, is hereby repealed. 

                 SECTION 2. That the Clerk of Council be, and she hereby is authorized and directed to notify the Cuyahoga County Board of Elections of the Council’s request to withdraw this issue from the November 4, 2008 ballot, and disregard any votes received for this issue.   

                SECTION 3.  This Ordinance is hereby declared to be an emergency
measure necessary for the immediate preservation of the public health, safety and welfare and for the further reason that it is immediately necessary to notify the Cuyahoga County Board of Elections of the Council’s request to withdraw this issue from the November 4, 2008 ballot; wherefore, provided this Ordinance receives the affirmative vote of two-thirds of the members of Council elected or appointed, it shall take effect immediately upon its passage and execution by the Mayor; otherwise, it shall take effect and be in force from and after the earliest period allowed by law.
